While an accused made the subject of a s.37 hospital order by magistrates can appeal to the Crown Court there is no statutory right of appeal from an order made under s.5 of the Criminal Procedure (Insanity) Act 1964 and the provisions of Sch.1 Criminal Procedure (Insanity and Unfitness to Plead) Act 1991.
