Where an offender had produced racially inflammatory material and posted it on a website hosted by a remote server in the United States, he could be tried in the United Kingdom because a substantial measure of his activities had taken place in the UK, as required by the test laid down in R. v Smith (Wallace Duncan) (No.4) [2004] EWCA Crim 631, [2004] Q.B. 1418 .
