In an appeal against conviction for an offence of fraudulently evading the prohibition on the importation of Class A drugs, as a result of the judge's comments on the issue of calling witnesses to support the appellant's case and an unclear direction as to the meaning of "duress", the conviction was unsafe and would be quashed with an order for a re-trial.
