A judge had erred when declining to exercise his discretion pursuant to the decision in R. v Sorhaindo (Christopher) [2006] EWCA Crim 1429 to allow the vacating of guilty pleas to possession of Class A drugs with intent, because rather than focussing on whether the defendant had a good defence in law based on his instructions to counsel, he had concentrated on the facts as he considered them to be on the evidence.
