A judge had erred in referring to the "practice of this court" and appearing to depart from the sentencing guidelines when sentencing an offender to 12 months' imprisonment for possession of articles for use in fraud, related to the use of a device for obtaining bank cards and customer details from cash machines. The prevalence of such offending had been taken into account when setting the guidelines and the appropriate sentence in the circumstances was one of eight months' imprisonment.
