[2007] EWCA Crim 1937

The correct standard of proof to be established for the commission of an offence through neglect under the Health and Safety at Work etc. Act 1974 s.37 was a state of fact that required action to be taken, of which the company officer ought to have been aware, and into which appropriate investigation ought to have been made.
