If the court determined that an appellant was unfit to plead, then it was the court's duty under the Criminal Procedure (Insanity) Act 1964 to consider carefully who was the best person to be appointed to put the case for the defence, and it was the court's responsibility to be satisfied that the person appointed was the right person.
