The court considered the dangerous offender provisions contained in the Criminal Justice Act 2003 in relation to offences that straddled the commencement date of the provisions. Where offences were committed after April 4, 2005, the provisions should be applied and any other offences, including those committed prior to the commencement date, could be considered by the sentencing judge in making an assessment of dangerousness under s.229 of the 2003 Act.
