[2007] EWCA Crim 538

Where a sentencing court wrongly imposed an extended sentence in respect of a "serious offence" under the Criminal Justice Act 2003 , the Court of Appeal was precluded by the Criminal Appeal Act 1968 s.11(3) from imposing a sentence of imprisonment for public protection even though that was the mandatory sentence under the 2003 Act.
