[2010] EWCA Crim 78

A sentence of 15 months' imprisonment for racially aggravated common assault, which included 10 months for the racial element, was excessive and was replaced with a total sentence of 10 months, as the racist remarks were used to cause offence and were not an indication of racial motivation.
