Where a defendant had committed an offence while released on licence, there was no power under the Powers of Criminal Courts (Sentencing) Act 2000 to increase the appropriate sentence for that offence on the basis that prior to sentence the defendant had been recalled to custody because he had breached the terms of the licence.
