Notwithstanding the differing ages of the victims, a judge had been justified in admitting an offender's previous conviction for the gang rape of a 15-year-old girl as evidence of his propensity for non-consensual sex with a young girl following his being charged with the rape of his 11-year-old niece, as both the conviction and the allegation involved the underlying use of power.
