Where a defendant had been convicted of serious criminal offences involving dishonesty, but those offences had to be quashed on a legal point brought about by the judgment in R v Preddy & Ors (1996) 3 WLR 255, then, if the law permitted, justice and the public interest demanded that an alternative offence should be substituted.
