A judge had erred in failing to direct a jury as to whether an adverse inference should be drawn in relation to discrepancies between an unsigned defence statement and the evidence given by the defendant at his trial for dangerous driving. However, despite the defects in the judge's approach, the conviction was safe: the jury had believed the accuracy and reliability of a police officer who had witnessed the driving, and had rejected the reliability and credibility of the defendant's evidence.
