R v KS (2010)

PUBLISHED July 23, 2010

[2010] EWCA Crim 1756

When balancing the nature of the threat and danger of contamination of a jury caused by jury tampering against the steps reasonably available to reduce the risk to manageable proportions, the proposed protective measures had to be proportionate to the threat. Caution was to be had regarding unduly alarmist proposals and the likely adverse impact on members of the jury and the drain on precious police resources.
