The expression "serious harm whether physical or psychological" in the Criminal Justice Act 2003 s.224(3) had to be seen in the context of the overall definition of serious harm, which was death or serious personal injury. An offender who had committed a number of robberies and caused fear in his victims had not crossed the dangerousness threshold, as fear did not automatically equate to psychological harm.
