Although there was an issue as to whether it could be said that forged documents were under the "control" of an offender, where he had ordered and paid for them but had not received them, the offender had nevertheless pleaded guilty to the offence under the Fraud Act 2006 s.6. The court was far from satisfied that the purported defence based on control would probably have succeeded, such that it could be said that there had been a clear injustice.
