[2002] EWCA Crim 1318

It was for the prosecution to prove absence of belief of age in a case of indecent assault on a boy under 16. An injustice could arise where the defendant had no opportunity for the issue of his belief to be determined by a jury or a judge upon guilty pleas. This case is reported at Times, June 26, 2002.
