[2012] EWCA Crim 766

A judge had not made an error of law in allowing an amendment to an indictment to add a count charging a summary offence where the prosecution had, at trial, not proceeded with an indictment for an indictable offence, and where the facts for the summary offence comprised part of the facts within the indictable offence.
