An appeal against sentence was successful where an order under the Powers of Criminal Courts (Sentencing) Act 2000 s.116 had been made on the basis of a sentence in respect of the original offence for which a prisoner was returned to prison, instead of being applied as a consequence of a wholly fresh sentencing exercise.
