EWCA Crim 2018
In all the circumstances a sentence of two-years for breach of a restraining order was manifestly excessive and, even though the defendant contested the matter, a sentence of 18 months would be substituted. Inadequate weight had been given to the fact that the breach was the first and had been spontaneous. Whilst there were no guidelines, authorities indicated sentences ranging between 12 months and two years.
