The concept of the notional minimum term in the Criminal Justice Act 2003 s.225(3C) was concerned only with whether the threshold for the imposition of a term of imprisonment for public protection was met and was irrelevant to the setting of the actual minimum term under the Powers of Criminal Courts (Sentencing) Act 2000 s.82A.
