Where appeals against conviction were heard and the judges had agreed the outcome but had not reduced their decision into writing, the appeals had not been determined for the purpose of the Supreme Court Act 1981 s.55(4)(a)(i) . Accordingly, where the presiding judge had died, the remaining two judges did not have jurisdiction to write and deliver the judgment.
