It was only in unusual and pressing circumstances that the police were likely to be justified in invoking the power under Code C to exclude a solicitor's representative from a police station. However, an ex police officer, who had been dismissed from the police force and had an appeal pending, who attended a police station as a solicitor's representative were circumstances in which the police could exclude that person on the grounds of a conflict of interest which would hinder a criminal investigation.
