The appellant's conviction for sexual assault on a child aged under 13 was unsafe as the judge had failed to sufficiently examine the question of whether the evidence had been contaminated for the purposes of the Criminal Justice Act 2003 s.107 in light of the victim's evidence that his mother had told him what to say.
