On the facts the summary offence of taking a conveyance without authority could be joined, under the Criminal Justice Act 1988 s.40, with the indictable offence of burglary, which was committed to the Crown Court, as the offences were founded on the same facts. However, a count of driving while disqualified was wrongly joined as it was not founded on the same facts.
