It was not open to a defendant charged in criminal proceedings with failing to comply with an enforcement notice, which had become effective after an unsuccessful appeal or in the absence of an appeal, to rely in his defence on the terms of a certificate of lawful use that had been granted in relation to some of the land affected by the enforcement notice.
