The appellant's conviction for causing bodily harm by wanton driving was quashed as the judge's direction was flawed in a number of respects. In particular, the judge had wrongly narrowed the issues in the case down to one question and had inadvertently reversed the evidential burden of proof by placing on the appellant an obligation to provide an acceptable explanation for her actions.
