[2002] EWCA Crim 2170

There was sufficient evidence that the first appellant had been driving his car when it crashed, despite CCTV evidence showing his passenger getting into the driver's seat shortly beforehand. Therefore his conviction for causing death by dangerous driving was safe. Appeals against sentence by him and his co-defendant were dismissed.
