[2006] EWCA Crim 2856

The judge had been entitled to exclude bad character evidence adduced by one co-defendant against another where in the context of the case it was not relevant within the terms of R v Bracewell (Michael Geoffrey) (1979) 68 Cr App R 44, and was not substantially probative of a matter in issue, within the Criminal Justice Act 2003 s.101(1)(e) .
