R v (1) LOWE (2) SHEEKEY (2013)

PUBLISHED October 25, 2013

[2013] EWCA Crim 2218

An offender's sentence of four years and nine months' imprisonment for being knowingly concerned in the fraudulent evasion of duty payable on the importation of cigarettes and rolling tobacco was reduced to three-and-a-half-years' imprisonment, as the judge had incorrectly sentenced him on the basis that he was the leader of a concealment scheme when he had in fact played a significant role. The co-accused had been correctly sentenced to four years' imprisonment for the same offence as his offending had spanned the entire two-year period, unlike the offender.
