The powers to make a confiscation order under the Criminal Justice Act 1988 and the Drug Trafficking Act 1994 did not, in principle, contravene Art.6 European Convention on Human Rights. However, whether Convention rights had been breached would depend on the facts of a case. * This case has been appealed to the House of Lords.
