[2007] EWCA Crim 342
The court formulated a four-step approach to the "fundamentally different" test which operated where a group of attackers had unlawfully caused the death of the victim intending to kill him or cause serious harm and where each defendant had participated in the attack and the court had to determine the extent of the participation. The court also gave guidance about how cases of joint enterprise murder should be summed up to a jury.
