Before the court could be satisfied that a witness did "not give oral evidence through fear" for the purposes of s.23 Criminal Justice Act 1988, it should be informed of any efforts that had been made to persuade the witness to attend or to alleviate his fears such as an offer of witness protection or screens at court.
