It was a justified interference with an individual's rights under the European Convention on Human Rights 1950 art.8 to retain police records relating to an unfounded allegation of sexual assault made against him nine years earlier. The Commissioner of Police had demonstrated that the use to which the records might be put justified their retention, particularly since they were not disclosable to the public and were restricted to those who investigated crime.
