It had been inappropriate to continue with a judicial review application in light of the steps which had been taken by the Secretary of State for the Home Department to rectify a delay in returning a foreign national's passport as the delay had been the result of an administrative error rather than discrimination and the foreign national had failed to exhaust the Home Office's complaints procedure.
