Documents held by a solicitor for a client in a criminal prosecution could be exempt from legal professional privilege on the basis that they disclosed a conspiracy to pervert the course of justice if there was free-standing, independent evidence to that effect but not if the issues raised were those to be decided in the substantive trial.
