The judge was right to discharge the jury and give judgment for the Commissioner of Police on a claim for damages for wrongful arrest and malicious prosecution where there was simply no evidence that, at the time of arrest or at the police station, the arresting officer was acting from racist motives or to protect the wife of a fellow police officer, albeit that was the suspicion and asserted to be the case on the part of the claimant.
