Where a prisoner had instructed an Italian avvocato as his legal representation, the avvocato was a "legal adviser" for the purpose of r.2 Prison Rules 1999 SI 1999/728. A decision to refuse the avvocato access to his client was unlawful pursuant to Art.6(3) European Convention on Human Rights.
