The Court of Appeal of Trinidad and Tobago was correct to decide that the appellant police officer's circumstances were not similar to that of another officer who had been promoted after suspension and that accordingly the Commissioner of Police of Trinidad and Tobago had not subjected the appellant to unequal treatment in refusing to recommend him for a promotion.
