In an appeal concerning the strike out of parts of the particulars of claim the court had hesitated on the matter of aggravated damages as it was "peculiarly sensitive" to the facts of the case. However the judge had been premature to strike out that part of the claim and thus the appeal was allowed to that limited extent.
