[2008] EWHC 151 (Ch)

The Prison Service Order 6300 para. 5.2 was unlawful in so far as it purported to require the permission of the sentencing judge to be obtained before a contempt prisoner could be granted temporary release. Entitlement to be considered for release on temporary licence was a matter for the prison authorities and it did not concern the sentencing judge.
