The Legal Services Commission was empowered, having determined that a case was no longer active, to make a "nil assessment" in respect of final costs and recoup moneys paid to solicitors for payments on account of work undertaken for clients issued with legal aid certificates under the Legal Aid Act 1988 pursuant to the incidental power in s.4(1)(b) of the Act.
