The judge was wrong to conclude that a breach of the peace was imminent where there was no substantial evidence that the appellant was acting in a violent or threatening way. Accordingly, it was apparent that the appellant was both wrongly arrested and falsely imprisoned and was entitled to an award of general damages of #1,250.
