A review officer conducting a review under the Finance Act 1994 s.14 and Sch.5 of a decision to restore vehicles on terms had wrongly limited her approach to validating the quantum of the restoration fee against the sums set out in Customs' policy for road vehicles with rebated or marked fuel.
