JOHN ANDREW MARTIN V CHIEF CONSTABLE OF NOTTINGHAMSHIRE & ANOR (1999)

PUBLISHED October 29, 1999

A claim for damages against the Chief Constable of Nottinghamshire failed where, in arresting and detaining the claimant in relation to the theft of a car, the police had acted within the requirements of Police and Criminal Evidence Act 1984: however the car appeared to have been detained longer than was necessary for the purpose of establishing its rightful owner, and the claim in that regard should be remitted for retrial.
