[2004] EWCA Civ 308

The claimant had an arguable case, in an action for damages for false imprisonment and malicious prosecution, that decisions by the police to arrest him, charge him and refuse him bail were vitiated by an improper purpose. That case should not therefore have been removed from the jury.
