Where two police officers had entered the claimant's communal garden to find him in the honest but mistaken suspicion that he was hiding from them having committed a crime, his claim against them for assault and other torts failed. One of them had touched his arms when he said he was leaving, but that was justified and could not be assault given that he had just been warned that he would be detained.
