Where an accused had given notice of his intention to raise a devolution issue in relation to criminal proceedings, it was open to him, pursuant to s.72(3) Criminal Procedure (Scotland) Act 1995, to raise at a pre-trial hearing in relation to that issue any additional devolution issues that were properly available to him.
