When deciding whether to exclude the identification evidence of a police officer where the accused had disputed that evidence and no identification parade had been held, the focus for the purposes of s.78 Police and Criminal Evidence Act 1984 was on the identification evidence sought to be adduced, and not the effect of a failure to obtain a statement from another officer present at the time of the offence.
